Just when you thought it was safe to come out of the CDM
closet, the breakdown of prosecutions 2010 - 2011, show there to
have been 37 prosecutions under Parts 2 & 3 of CDM, compared to
only 15 in the previous year.
When Part 4 prosecutions are added in, the 2010-2011 CDM
figure of 53 is 280% more than the 19 in the previous year. Indeed,
the total is more than the previous four years put together.
Whilst we may all say that the figures are low, they are a
significant indicator of what might be an increasing trend of CDM
precautions. Indeed, we have the highest ever fines for a CDMC
(ironically as a PS under the 1994 Regulations) and a Designer,
whose combined penalty was £120K.
I set out below more of the detail of both the
prosecutions for the year and of the 368 cases since CDM began in
1994. Your views/thoughts would be welcomed as to where CDM is
taking us.
